These Terms and Conditions of Sale apply without restriction or reservation to all online sales proposed by the company Curioos on the Internet site www.curioos.com (hereinafter referred to as the “Site”).
The Site is for the publication of digital artwork, understood as all artwork created or reworked through digital media (hereinafter referred to as “Artwork”). In particular, it allows Internet users that so desire (hereinafter referred to as “Buyers”) to purchase limited edition prints of the Artwork, as well as all other products and accessories, such as frames, put on sale on the Site (hereinafter collectively referred to as “Products”).
The purpose of these Terms and Conditions is to define the terms and conditions of online sales and delivery of Products, as well as to define the rights and obligations of each of the parties within this context.
They can be accessed and printed at any moment from a direct link on the Site.
They will prevail over any other general or special terms and conditions not expressly agreed by the company Curioos. They may be subject to certain terms and conditions of use specific to certain Products or services. These specific conditions are hereby incorporated into the Terms and Conditions of Sale and, in the case of any inconsistency between the Terms and Conditions of Sale and these specific conditions, the latter will prevail.
Products are offered for online sale from the Site to the European Union (Corsica and French overseas departments and territories included for France), the United States of America, Canada, Brazil, Australia, Argentina, Chile, China, Colombia, Hong Kong, India, Israel, Japan, Mexico, Norway, New Zealand, Philippines, Russia, Switzerland, Thailand, Turkey and Ukraine.
2. The Seller’s identity and contact details
The Site is managed by the company Curioos, a limited liability company with a registered capital of 50,000 Euro, registered under number 512 083 189 with the Registry of Trade and Companies of Paris, whose head office is located at 10 rue de la Paix, 75002 Paris in France (hereinafter referred to as “Curioos”).

3. Acceptance of the Terms and Conditions
The Buyer declares, before placing an order, to have the full legal capacity to be bound by these Terms and Conditions.
The Buyer will confirm their acceptance of these Terms and Conditions by checking a checkbox in the order form. This acceptance can only be full and complete. Any qualified acceptance is considered as null and void. Any Buyer who does not accept to be bound by these Terms and Conditions must not place an order on the Site.
4. Product features
Before placing an order online and in accordance, notably, with the clauses of article L111-1 of the French consumer code, the Buyer can acquaint themselves, on the Site, of the features of each Product that they wish to order.
Products are offered for online sale within the limit of available product stock.
Photographs, representations and descriptions of Products offered for online sale are as precise as possible. Curioos is only bound by the Products precisely indicated therein.
5.1 Placing orders
To place an order, the Buyer must select the Products of their choice and place them in their shopping cart.

As part of the ordering process, the Buyer will be asked to provide their address for the purposes of delivery and invoicing. All fields in the order form marked as being required must be filled in. Orders cannot be validated unless they contain all required information.
The Buyer assures that all information they provide in the order form is exact, up to date and sincere and is in no way misleading or dishonest.
The Buyer is hereby informed and accepts that this information acts as proof of their identity and will be binding upon confirmation.
5.2 Creating an account after ordering
Once an order has been placed, the Buyer will be offered the option to choose a password and thus create an account (hereinafter referred to as the “Account”), which will enable the Buyer, for future orders on the Site, to access an order form that will be pre-filled with the contact details that they provided during their first order.
The Buyer agrees to update this contact information if ever it should change (in particular should they change address).
The Buyer is responsible for keeping their passwords confidential. They must contact Curioos immediately, through any of the channels mentioned in Article 2 of these Terms and Conditions, if they notice that their account has been used without their knowledge. The Buyer acknowledges Curioos’ right to take all measures it deems appropriate in a case such as this.
5.3 Order Confirmation
When an order has been placed, the Buyer will receive confirmation of the order by email.
The Buyer must make sure that the contact details that they entered when ordering or their updated contact details of their Account are correct and that they permit the Buyer to receive the order confirmation email. If the Buyer does not receive an order confirmation email, they must contact Curioos through the channels listed in Article 2.
Curioos advises the Buyer to keep the information contained in the order confirmation.
The order and its confirmation are considered as having been received when the parties to whom they are addressed have access to them.
6. Prices and methods of payment
The sale prices of Products are displayed on the Site.
They are indicated in dollars, all taxes included (French VAT and other applicable taxes).
For each Product, the Site displays, underneath the sale price in dollars, an estimated equivalent amount in euros, calculated based on the exchange rate used by the Paypal online secure payment service at the date the Site is being visited. This amount in euros is strictly for informational use only and does not bind Curioos in any way.
The sale price of a Product does not include any potential delivery charges, which would be invoiced in addition to the price of the Product being purchased, in accordance with the terms defined in Article 7. The amount of applicable delivery charges will be indicated before the Buyer validates their order.
The price that applies is the price displayed on the Site at the moment the Buyer’s order is being placed.
Caution: Outside the European Union, as well as in French overseas departments and territories, in addition to the price paid to Curioos, duties or local taxes may be pursuant and may be charged to the Buyer upon receipt of the parcel. These duties and taxes, the amount of which Curioos cannot predetermine and therefore cannot inform the Buyer prior to their order, remain at the Buyer’s charge and the Buyer remains solely responsible for the making of any related declarations and/or the obtaining of any related authorizations.
6.2 Means of payment
The total price of the Products is due for payment at the moment of the order.

The Buyer ensures Curioos that the former disposes of the required authorization to use the chosen means of payment.
Curioos reserves the right to suspend or cancel any order and/or delivery in the event of non-payment of any amount owed by the Buyer, any payment irregularity, or fraud or attempted fraud relating to the use of the Site.
Fees of an amount equaling one and a half times (1.5 times) the legal French interest rate will be applied to the unpaid amounts upon receipt of notification of bank transfer refusal.
6.3 Retention of ownership
Curioos retains full and complete ownership of Products sold until payment has been made in full.
7. Delivery of Products
7.1 Products will be delivered to the address indicated as the “delivery address” (which can be different to the invoicing address) provided at the moment the Buyer ordered.
Valid invoices accompany all deliveries.
7.2 Different delivery methods may be possible, depending on Product categories, their dimensions and their weight.
The Buyer will be informed when ordering of the different methods of delivery that are possible for the Product(s) being ordered and the charges corresponding to each method.
The Buyer must select the method of delivery that they wish to use and provide all necessary information to facilitate the successful delivery of the Product through this method.
7.3 A delivery date is indicated to the Buyer in the order confirmation email (as a rule this delivery takes place within two weeks of the order, unless indicated otherwise in the confirmation email).
In the event that a delivery is over seven days late with regard to the delivery date initially indicated in the order confirmation email, and this not justified by force majeure, the Buyer can cancel their order by registered letter with acknowledgement of receipt, sent to the address mentioned in Article 2 and obtain a full refund of the sums paid within thirty days, to the exclusion of all other compensation.
7.4 The Buyer will be informed at the earliest possible time in the event that an ordered Product is not available. The Buyer can in this case obtain a full refund of the sums paid within thirty days, to the exclusion of all other compensation.
8. Right of withdrawal
The Buyer has a limit of seven clear days from their receipt of the ordered Products to withdraw their order without having to justify their motives or pay any fees, apart from the return carrier costs.
They must contact Curioos through any of the channels mentioned in Article 2 of these Terms and Conditions, to inform Curioos of their wish to exercise their right to withdrawal.
Curioos will organize with the carrier of their choice the terms of the return, and will inform the Buyer of these terms through any pertinent channel.
Products must be returned to Curioos in their original packaging, with all of their accessories, free of any signs of use. A copy of the corresponding purchase invoice must be sent back with the Products.
The Buyer will be refunded promptly all sums paid for their order after deducting the return carrier costs, within two weeks at the latest following the withdrawal.
9. Legal safeguards
The Buyer enjoys legal safeguards against non-compliance as well as against latent defects of the thing sold.
If the Buyer notices that the Product they were delivered has a defect, is non-compliant or damaged, they must inform Curioos through any of the channels mentioned in Article 2 of these Terms and Conditions, indicating the nature of the defect, non-compliance or damage found.
Curioos will organize with the carrier of their choice the terms of the return, and will inform the Buyer of these terms through any pertinent channel. Curioos will cover the return carrier costs.
Products must be returned to Curioos in their original packaging, with all of their accessories. A copy of the corresponding purchase invoice must be sent back with the Products.
For Product returns to be accepted they must be returned following the terms stipulated above.
Curioos will make the necessary verifications and will offer to repair or replace the Product for the Buyer if possible.
If repair or replacement of the Product is not possible, Curioos will offer to refund the Buyer the full price paid for the Product as well as the related delivery charges. The Buyer will be refunded promptly, within two weeks following the date on which Curioos informed them of the fact that neither repair nor replacement of the Product was possible.
Curioos agrees to regularly check that the Site is operational and can be accessed. To this end, Curioos reserves the right to interrupt access to the Site momentarily for maintenance purposes. In the same way, Curioos will not be held liable if the Site is ever momentarily difficult (or impossible) to access, the causes of these circumstances being outside Curioos’ control, force majeure, or due to disruption of the telecommunications network, and use of the site implicitly implies knowledge and acceptance of the characteristics and limits of the Internet and its associated technologies.
Any person connecting to the Site does so at their sole liability. It is the Buyer’s responsibility to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any harm.
Moreover, Curioos cannot be held responsible for any failure or delay in the execution of the sales contract due to force majeure or disruption or partial or total strikes of postal services, transport channels or communications.
11. Copyright and Intellectual Property
The systems, software, structures, infrastructures, databases and content (text, images, graphics, music, logos, trademarks, etc.) used by Curioos on the Site, as well as the Artwork presented on the Site, are protected by all intellectual property rights in force. Any dismantling, decompilation, deciphering, extracting, reusing, copying and, more generally, any reproduction, representation, publishing or use of all or part of any these items, without the authorization of Curioos and the designers/creators of the Artwork where appropriate, is strictly prohibited and could be subject to prosecution.
12. Personal Data
12.1 When the Buyer places an order, Curioos will require the Buyer to provide certain personal data, i.e. information that will identify the Buyer, such as their family name, first name, street address or email address (hereinafter referred to as “Personal Data”).
Curioos complies, in the gathering and management of this Personal Data, to the current version of the French law N° 78-17 dated January 6, 1978 on Computer Processing, Filing Systems and Liberties.
12.2 The Personal Data collected when the Buyer is placing an order is necessary to manage and monitor the order and is intended only for Curioos and its partners to whom it will have recourse to process the order (including carriers to whom Curioos will entrust delivery of Products). Curioos can also forward this data to the administrative and legal authorities in order to comply with its legal and regulatory obligations. Curioos is committed to protecting this Personal Data, and will treat it with the strictest confidentiality and the highest level of care.
Personal Data will not be communicated to third parties (understood as any entity other than Curioos or its partners) unless the Buyer expressly gives their agreement to this communication.
12.3 Curioos may use the Personal Data when contacting the Buyer with promotional messages. Any Buyer who does not wish to receive such messages can refuse them when entering their Personal Data, using the checkbox designed for this purpose.
12.4 In accordance with French law N° 78-17 dated January 6, 1978 on Computer Processing, Filing Systems and Liberties, the Buyer has the right to obtain and, where appropriate, correct or delete information concerning them, by contacting Curioos through any of the channels listed in Article 2. The Buyer may, for legitimate reasons, oppose the processing of their Personal Data.
13. Commercial Advertising
Curioos may insert advertising or promotional messages on any page of the Site in a format, and according to the conditions, that Curioos deems appropriate.
14. Links and Third-Party Sites
Curioos can in no way be held liable for the technical availability or unavailability of Internet sites run by third parties – including Partner Sites - that the Buyer may access through links on the Site.
Curioos will not take on any liability for content, advertisements, products and/or services available on such third party sites and Users are hereby reminded that these sites are governed by their own terms and conditions of use.
Curioos is also not liable for any transactions conducted between the Buyer and any advertisers, professionals or salespersons to which the Buyer may be oriented through the Site and will not be part of any disputes whatsoever with these third parties particularly concerning the delivery of products and/or services, guarantees, declarations or other obligations whatsoever to which these thirds parties may be bound.
15. Prohibited behavior
15.1 The following behavior is strictly forbidden: (i) any behavior that would interrupt, suspend, slow down or prevent correct operation of the Site, (ii) any hacking or attempts to hack into Curioos’ IT systems, (iii) any hijacking of the Site's system resources, (iv) any acts that would place a disproportionate load on the Site's infrastructure, (v) any attempts to breach the Site's security and authentication structures, (vi) any acts that could infringe on the rights and financial, commercial and moral interests of Curioos or of the users of its Site, (vii) any action that uses the Site for purposes other than that for which it was designed and finally generally, (viii) any breach of these Terms and Conditions or of any local policy or laws.
15.2 It is also strictly prohibited to make money from, sell or concede all or part of one's access to the Site or to the information that it contains.
15.3 In the event of a breach of any of the provisions of this article or more generally, of any laws and regulations, Curioos reserves the right to take any measures it deems appropriate and to instigate any legal action.
Curioos reserves the right to modify these Terms and Conditions of Sale at any time. In this case, the conditions that will apply will be those in force on the date the Buyer places their order.
In the event of a translation of these Terms and Conditions into one or more languages, the language of interpretation will be French in the event of any contradiction or dispute concerning the meaning of any one of their terms or provisions.
18. Law and Jurisdiction
These Terms and Conditions are governed by French law.
In the event of dispute concerning the validity, interpretation and/or application of these Terms and Conditions, all parties agree that the courts of Paris shall be the only competent jurisdiction capable of judging the dispute, save conflicting mandatory rules of practice.
19. Entry into Force
These Terms and Conditions became effective on October 17, 2011.

What is Curioos’ return policy?

What should I do if my print/product is damaged during shipping?

Does Curioos have any recommendations on conserving the quality of my print?
The good news is that Curioos prints outlast many of our competitors. However, it’s always best to keep your print out of direct sunlight and in a place that’s not too hot or humid. Framing is always a good option to protect it from dust, water damage, and tears.
